Trinity שלום, שאלה יפה. אף שיש מקרים המצדיקים תביעות מסוג זה אין למיטב ידיעתי תביעות בתחום הוטרינרי. שאלה מעניינת תהיה מי יעיד על הכאב והסבל שנגרם לחתול בשל רשלנות הוטרינר?

A Dayton lawyer filed a lawsuit this week on behalf of both Poopi and its owners. The couple dropped off the dog at a Xenia veterinarian for a tooth cleaning, and he tried to spay it _ for a second time. This is the second lawsuit attorney Paul Leonard, founder of the nonprofit Center for Animal Law and Advocacy, has filed on behalf of an injured pet in an attempt to change Ohio law. The other case involves a dog burned by an invisible fence. Leonard, a former Dayton mayor and former Ohio lieutenant governor, filed the poodle lawsuit this week in Greene County Common Pleas Court. Sean and Melissa Oberschlake of Cedarville are suing Veterinary Associates Animal Hospital and veterinarian Christian Hurst. The owners are suing on behalf of the dog, as if it were a child. The clinic's office manager, who gave her name only as Vickie, said she could not comment on an open case. She said Hurst left the clinic in late June for unrelated reasons. In each case, Leonard hopes the judge lets owners sue for malpractice and emotional distress. In 27 states, inhumane or cruel treatment of animals is recognized as a felony. Ohio is not one. Leonard hopes his lawsuits will change Ohio law by setting a legal precedent, even if legislators are unwilling to make penalties more harsh. He said he will appeal each case if necessary, and expects the issue to wind up before the Ohio Supreme Court. The lawsuit says Melissa Oberschlake dropped the dog off at the clinic in March for a tooth cleaning. When she called to check, she was told there was an accidental incision. The dog had a three-inch wound. Another vet determined an attempt had been made to spay the already neutered poodle. ``The dog has never regained its full strength and is just not the same dog emotionally,'' Leonard said.
